These Terms of Service ("Terms") govern your access to and use of the perf-lint dashboard and API at perflint.martkos-it.co.uk (the "Service"), operated by Martkos IT Ltd ("we", "us", or "our"), a company registered in England and Wales with company number 10082667 and registered office at Apollo House, Hallam Way, Whitehills Business Park, Blackpool, FY4 5FS.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
perf-lint is a static analysis tool for performance test scripts (JMeter, k6, Gatling). The Service comprises:

To use the dashboard you must register an account with a valid email address and a password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at support@martkos-it.co.uk of any unauthorised use of your account.
You must be at least 18 years of age to create an account. By registering, you represent and warrant that you meet this requirement.
API keys are credentials that allow the CLI to submit scan results to your dashboard. You are solely responsible for keeping your API keys secure. Do not share them publicly (e.g., in public repositories). We will not be liable for any loss or damage arising from your failure to protect your API keys. You may revoke and regenerate keys at any time from the dashboard.

The Service is offered on a tiered basis. The Free tier is available at no charge. Pro and Team tiers require a paid subscription, processed through Lemon Squeezy. All payments are subject to Lemon Squeezy's terms.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time from your account settings. Refunds are subject to our refund policy and applicable consumer law.
We reserve the right to change pricing with reasonable advance notice. Continued use of the Service after a price change constitutes your acceptance of the new price.
When you use an API key, your CLI sends scan metadata (violation counts, rule IDs, file scores, and framework type) to the Service. We do not receive the contents of your performance test scripts. You retain full ownership of your data. We process it solely to provide the dashboard functionality described in these Terms.
We may aggregate and anonymise scan data across all users to improve the Service (e.g., understanding which rules fire most frequently). No data that identifies you or your organisation will be included in any such aggregation.
The perf-lint CLI is open source and distributed under the MIT licence. The dashboard, API, and associated proprietary software remain the exclusive property of Martkos IT Ltd and are protected by applicable intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in any Martkos IT Ltd intellectual property except the limited right to use the Service as described herein.
We aim to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where practicable. We will not be liable for any downtime, data loss, or interruption of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. perf-lint identifies potential quality issues in performance test scripts; it does not guarantee that scripts passing all checks will perform correctly in production.
To the fullest extent permitted by law, Martkos IT Ltd, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
We may suspend or terminate your account at any time for breach of these Terms, or if we reasonably believe your use poses a risk to the Service or other users. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. Material changes will be notified by email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
